Welcome to the Mythic-Fox.com website. Mythic Fox, LLC, doing business as Mythic Fox Manga and Comics (“Mythic Fox”), owns and operates www.mythic-fox.com (the “Site”). These Terms of Use constitute a legally binding agreement between you and Mythic Fox. Please read these Terms of Use, the Privacy Policy, or any additional terms and conditions, policies, and guidelines posted on any other website, application, or services provided by Mythic Fox carefully before using the Mythic Fox services, including the Site. By visiting and using the Site or creating an account, you agree to these Terms of Use as a binding legal agreement between you and Mythic Fox without limitation or qualification. If you do not agree to these Terms of Use and to follow all applicable laws, then you may not use the Site and should leave the Site immediately. 

These Terms and Conditions of Use require the use of binding arbitration to resolve disputes rather than jury trials or class actions. Please see Section 19 for details, including instructions to follow to opt out of binding arbitration and the class action waiver.

We reserve the right at any time and without notice to change these Terms of Use simply by posting such changes on the site. Any such change will be effective immediately upon posting. You agree that each visit you make to the site shall be subject to the then-current Terms of Use. You agree to periodically re-read these Terms of Use so that you are aware of any changes to them.

By continuing to use the Site, now or following any changes to the Terms of Use, you confirm that you have read, accepted, and agreed to be bound by the Terms of Use and any such modifications. You agree that your continued use of the Site and your receipt or use of data and content through the Site constitutes reasonable and valuable consideration to support these Terms of Use.

  1. License

Mythic Fox grants the User a limited, nonexclusive, revocable license to access and make personal, non-commercial use (unless User has a business relationship with Mythic Fox documented in a separate agreement) of the Mythic Fox Services, its Content (as that term is defined in Section 4 below). Additional terms and conditions apply to User-Created Content, as that term is defined below. Mythic Fox grants a limited, non-exclusive, revocable license to view the Site and download, email, share via social networking, or print individual pages from the site, in accordance with these Terms of Use and solely for your own personal and non-commercial use. Mythic Fox further grants the User a limited, nonexclusive, and revocable right to create a hyperlink to the Mythic Fox Services so long as the link does not portray Mythic Fox, its subsidiaries, and affiliates, or their respective products or services in a false, misleading, derogatory, or otherwise offensive matter. 

You agree that in engaging in any of the above activities, you will not remove any trademark, copyright, or other notice contained on such pages. You acknowledge that Mythic Fox may revoke permission to use the Site in this manner at its discretion at any time for any or for no reason. Nothing on the Site shall be construed as granting in any way any license or right to use any of the Materials or other proprietary content in any other way without the express written permission of Mythic Fox. We reserve any rights not expressly granted in these Terms of Use.

  1. Restrictions on Use of Mythic Fox Materials

The content of the pages of this Site is for your general information and use only. It is subject to change without notice.

The Site, including, but not limited to, the text, content, photographs, images, video, audio, graphics, and any software (including data or images incorporated into, generated by, or accompanying the software) available on or through the site or contained on the site (“Materials”) are owned and operated by Mythic Fox or third-party companies with which Mythic Fox does business. The Materials are protected by copyright, trademark, trade secret, domain name, patent, and/or other proprietary rights and by federal and state laws. Unless otherwise indicated on the Site and except for the trademarks, service marks, and trade names of other companies and/or organizations that are displayed on the Site, all trademarks, service marks, and trade names are proprietary to Mythic Fox. You agree to abide by all applicable intellectual property laws and any additional notices or restrictions contained on the Site. You acknowledge that unauthorized use of the Materials or modification thereto is a violation of Mythic Fox’s trademark, copyright, trade secret, and other proprietary rights.

Except as provided in these Terms of Use, the licenses in Section 1 do not include any rights to:

  1. modify, download (other than page caching), reproduce, copy, or resell Mythic Fox Services, the Content or any portion or derivative thereof;
  1. commercially use Mythic Fox Services, the Content or any portion derivative thereof (unless User has a business relationship with Mythic Fox, in which case such commercial use will be governed by the terms applicable to such business relationship);
  1. copy or download any User’s account or profile information for the benefit of any third party;
  1. enable high volume, automated, electronic processes that apply to the Mythic Fox Services or its systems, the Content, or any portion or derivative thereof;
  1. use any robot, spider, data miner, crawler, scraper or other automated means to access or index Mythic Fox Services or its systems, the Content, or any portion or derivative thereof for any purpose;
  1. interfere or attempt to interfere with the proper working of the Mythic Fox Services;
  1. bypass any measures used by Mythic Fox to prevent or restrict access to any portion of Mythic Fox Services, the Content, or any portion or derivative thereof;
  1. frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Mythic Fox;
  1. use Mythic Fox’s name, trademarks, services marks, or logos in any meta tags or any other “hidden text”; or
  1. compile, repackage, disseminate, or otherwise use data extracted from Mythic Fox Services.

The foregoing are expressly prohibited and the right to do any of the foregoing shall require Mythic Fox’s express written consent (which may include a written agreement signed by an authorized representative of Mythic Fox). Any unauthorized use of Mythic Fox Services, the Content, or any portion or derivative thereof shall terminate any license or permission granted by Mythic Fox.

You acknowledge that third-party service providers to which the Site links may impose additional terms and conditions of use set forth on such third parties’ websites. Your use of any Materials provided by third parties, may be subject to their additional terms and conditions of use. 

  1. Digital Millennium Copyright (DMCA) Notice

Mythic Fox respects the intellectual property rights of others and expects our Users to do the same. Mythic Fox strives to fully comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512. If you would like to notify Mythic Fox that you believe material on the Site infringes on your copyrights, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see § 512(c)(3) of the DMCA to confirm these requirements):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (Providing URLs in the body of an email is the best way to help us locate the content quickly.);
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
     
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note that under § 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees. Please also note that the information provided in your notice of infringement may be forwarded to the person who provided the allegedly infringing content. 

If you elect to send Mythic Fox a counter notice, such written notice should be sent to our Designated DMCA agent, noted above. Note that under § 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability. Please know that we enforce a policy that provides for termination of the membership account, in appropriate circumstances, of account holders who are repeat infringers.  

  1. Copyright and Trademark/Service Mark Notice

Unless otherwise noted, all Materials are owned, licensed, or controlled by Mythic Fox or other third party credited as the provider of the Materials. You shall not sell, license, rent, modify, copy, reproduce, distribute, display publicly, publish, edit, reverse engineer, or create derivative works from any Materials or otherwise transfer any Materials to any third person without the express written permission of Mythic Fox or the appropriate third party who provided the Materials.

User acknowledges that the Mythic Fox Services contain certain content (such as text, graphics, photographs, video, audio, code, and other data or information relating to any subject) (“Content”), that is protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media, and technologies existing now or developed later. All Content is or may be copyrighted as a collective work under the U.S. copyright laws, and Mythic Fox owns a copyright in the selection, coordination, arrangement, and enhancement of such Content on the Site. 


User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any such Content, in whole or in part. If no specific restrictions are displayed, Users may make copies of select portions of the Content, provided that the copies are made only for User’s personal use and that User maintains any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see, e.g., 17 U.S.C. § 107), User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other property right. In addition to the foregoing, use of any software Content shall be governed by these terms and any software license agreement accompanying such software.

Unless noted otherwise, all trademarks, service marks, domain names, and trade dress displayed on the Site, registered and unregistered, are owned by Mythic Fox and are protected by state, federal, and international trademark laws, as well as unfair competition and other laws. Our marks, names, logos, and trade dress include, but are not limited to, MYTHIC FOX, mythic-fox.com, the Site trade dress, and any Mythic Fox logos. The use or misuse of these marks or any other Materials, except as permitted in these Terms of Use, is expressly prohibited.


We actively and aggressively enforce Mythic Fox’s intellectual property rights. 

  1. Third-Party Content 

Mythic Fox is a distributor and not a publisher of Content supplied by third parties and Users. Mythic Fox has no editorial control over such Content. Mythic Fox is not obligated to review Content, including User-Created Content, as that term is defined in Section 15 below. Any opinions, advice, statements, services, offers, or other information that constitutes part of Content, including User-Created Content, expressed or made available by third parties, including any other User, are those of the respective authors or distributors and not of Mythic Fox or any Mythic Fox Provider, unless expressly stated otherwise. Neither Mythic Fox nor any Mythic Fox Provider makes any representation, warranty, or guarantee on the accuracy, completeness, or usefulness of any third-party Content, unless otherwise expressly stated. In many instances, the Content, including User-Created Content, available through Mythic Fox represents the opinions and judgments of the third party that provides such Content. Under no circumstance shall either Mythic Fox or any Mythic-Fox.com Provider be liable for any loss, damage, or harm caused by a User’s reliance on information obtained through Mythic Fox. It is the responsibility of User to evaluate the accuracy, completeness, or usefulness of the information, opinion, advice, or Content, including User-Created Content, available through Mythic Fox.

  1. Prices 

The price for an item on the Site may differ from the price shown in a User’s shopping cart, and it is possible that such price may increase or decrease between the time the item is placed in a shopping cart and the time that the purchase is actually made. On rare occasions, an item may be priced incorrectly on the Site. If the price for the item on the Site is incorrect and is actually higher than the price provided at the time of purchase, then, at the sole discretion of Mythic Fox, Mythic Fox may either (a) contact the User for instructions before shipping the item or charging the User for such item; (b) cancel the order for such item and notify the User of such cancellation; or (c) ship the item at the incorrect price to the benefit of the User.

  1. Risk of Loss

The risk of loss and title for all items purchased via the Site and Mythic Fox Services pass to the User upon delivery of the item to the carrier.

  1. Product Description

The items offered for sale on the Site contain descriptions that are provided directly by the publisher, manufacturer, developer, or distributor of such item. Mythic Fox does not represent or warrant that the descriptions of such items are accurate or complete. IF A USER PURCHASES AN ITEM FROM MYTHIC FOX THAT IS NOT AS DESCRIBED ON THE SITE, THE USER’S SOLE AND EXCLUSIVE REMEDY IS TO RETURN SUCH ITEM IN AN UNUSED CONDITION FOR A REFUND OF THE PURCHASE PRICE.

  1. Links to Third-Party Sites

The Site may offer links to other websites, which may or may not be affiliated with Mythic Fox. Such websites may be created, sponsored, and/or maintained by third parties. We are not responsible for the contents of any website pages created, sponsored, and/or maintained by any third party independent of Mythic Fox. We have no control over such third-party website pages, and we do not guarantee the accuracy, completeness, or timeliness of the information on such sites. You agree that your use of such information is voluntary and that you visit any such websites at your own risk. No reference to commercial products or services within any such third-party website pages constitutes or implies an endorsement or recommendation by Mythic Fox. 

We cannot and do not guarantee the security of any information transmitted through or stored on such third-party sites. You provide information to such third parties at your own risk. Mythic Fox makes no representations, guarantees, or warranties as to, and shall have no liability for, any content delivered by any third party or for any use of personal information you provide to any such third party.

  1. Resources Provided on the Site

The Site may provide general information about manga, comics, and collectables and may link to various related resources. The Site, and its information and resources, are not intended to be a substitute for professional advice. We make no representations, guarantees, or warranties as to the accuracy or reliability of, and shall have no liability for, any information referenced on the Site or any content found on any third-party resource website. 

  1. Age of Users

Our products and services are marketed for and directed towards purchase by adults or with the consent of adults. Individuals under the age of 18 (“Minors”) are not permitted to use the Site without the supervision of a parent or legal guardian. Furthermore, we do not knowingly collect or solicit personal information from children under the age of 13 or knowingly allow such persons to register for an online account or to post personal information on our websites. Should we learn that someone under the age of 13 has provided any personal information to or on the Site, we will remove that information as soon as possible.

  1. Termination

Mythic Fox may issue a warning, temporarily suspend, indefinitely suspend, or terminate any User’s right to use or access all or any part of the Site including any account thereon, without notice, for any reason in Mythic Fox’s sole discretion, including, without limitation, violation of the Terms of Use, Mythic Fox’s belief that such access would violate any applicable law, or would be harmful to the interests of, or potentially cause financial loss or legal liability to, Mythic Fox, any Mythic Fox Provider, or another User.

In certain cases, in Mythic Fox’s sole discretion, Mythic Fox may provide written notice (a “Restriction Notice”) to a User (a “Restricted User”) to inform such Restricted User that (i) his or her right to use or access any part of the Site has been terminated, including the right to use, access, or create any account thereon; (ii) that Mythic Fox refuses to provide any services to such Restricted User; and (iii) any subsequent orders placed by a Restricted User will be subject to cancellation. Other conditions may apply and shall be set forth in the Restriction Notice.

  1. Mythic Fox Rewards

If you would like to join the Mythic Fox Community and have full access to the Site and to Mythic Fox Rewards provided through the Site, you must register as a member and create a membership account with Mythic Fox. To register and create an account, you must select a unique account name and password. You must also provide certain personal information. You agree to provide true, accurate, current, and complete information as prompted by the registration form on the Site. If you provide, or if Mythic Fox has reason to suspect that you have provided, information that is untrue, inaccurate, not current, or incomplete, we may refuse all current or future use of the site and/or services by you. Account Password – Every User that has an account for the Site is responsible for (i) keeping his or her account password confidential and secured; (ii) avoiding unauthorized access to such User’s computer or other devices; and (iii) keeping the contact information associated with that account current. User acknowledges that it is necessary to keep the e-mail address associated with his or her account current, because although the User may be able to log into his, her, or their Mythic Fox account using an old e-mail address, such User will not receive messages from Mythic Fox about his, her, or their orders, inquiries, or other matters.


Account Security – User accepts full responsibility for all activities that occur within such User’s Mythic Fox account or within the Mythic Fox interactive community, whether or not authorized by the User.


Operation of the Site and/or Services – Mythic Fox reserves the right, in its sole option and discretion, to modify, suspend, or discontinue at any time, with or without notice, the Site and/or Mythic Fox Rewards offered through the Site. Your right to use the Site and services will end if your account is terminated.

  1. Interactive Features

The Site offers numerous opportunities for interactive activities, which enable Users to communicate with each other directly, or which enable Users to post information and other material that will be visible to other Users of those services (“Interactive Features”). This Section 14, Interactive Features, applies to the activities of persons who are using the Interactive Features within the Site (“Interactive Users”). The scope of these features may change from time to time, with or without notice. You are using Interactive Features if you post a review, create a list, create a profile, submit any other User-Created Content, as defined below, or otherwise participate in any interactive feature.


Interactive Features may be used only for lawful purposes in accordance with these Terms of Use. If you are using any Mythic Fox Services Interactive Features, and post, publish, or communicate any information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material on or through the Interactive Features, please carefully choose the information that you post and/or provide to other Users (“User-Created Content”). User is prohibited from posting on or transmitting through the Site and Mythic Fox Services any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law. Mythic Fox reserves the right, in its sole discretion, to reject, refuse to post, or remove any posting or other User-Created Content (including private messages) by you, or to deny, restrict, suspend, or terminate access to all or any part of the Interactive Features at any time, for any or no reason, with or without prior notice or explanation, and without liability.


Mythic Fox reserves the right, in its sole discretion, to remove your profile and/or deny, restrict, suspend, or terminate your access to all or any part of the Interactive Features for any reason.

If you become aware of misuse of the Interactive Features, including any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violates any applicable law, please notify Mythic Fox immediately at [email protected] or 1 (571) 600-6760.

User-Created Content – Notwithstanding the foregoing, Mythic Fox assumes no responsibility for ongoing monitoring of the Site or Interactive Features or for removal or editing of any User-Created Content, even after receiving notice. Mythic Fox assumes no liability for any action or inaction with respect to conduct, communication, or User-Created Content within the Interactive Features. You are responsible for your interactions with other Users.


You may not post User-Created Content that: 

  1. involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”; 
  1. contains restricted or password only access pages or hidden page or images (those not linked to or not otherwise from another accessible page); 
  1. solicits passwords or personal identifying information for commercial or unlawful purposes from other Users; 
  1. involves commercial activities and/or sales such as contests, sweepstakes, barter, advertising, or pyramid schemes; includes a photograph or video of another person that you have posted without that person’s consent; circumvents or modifies, or attempts to circumvent or modify, or encourages or assists any other person in circumventing or modifying, any security technology or software that is part of the Site or Mythic Fox services; 
  1. involves the use of viruses, bots, worms, or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network; 
  1. covers or obscures the banner advertisements on your personal profile page; 
  1. involves any automated use of the Site or Mythic Fox services, such as, but not limited to, using scripts to add friends or send comments or messages; 
  1. interferes with, disrupts, or creates an undue burden on the Site or Mythic Fox services or the networks or services connected to the Interactive Features; 
  1. impersonates or attempts to impersonate another User, person, or entity; 
  1. uses the account, username, or password of another User at any time or discloses your password to any third party or permits any third party to access your account; 
  1. sells or otherwise transfers your profile; 
  1. uses any information obtained from the Site or Mythic Fox services to harass, abuse, or harm another person or entity, or attempting to do the same.

Users may upload to or otherwise submit to the Site for distribution on the Site only: 

  1. User-Created Content that is not subject to any copyright or other proprietary rights restrictions; or
  1. User Created Content in which the owner or licensor has given express authorization for Mythic Fox to distribute over the Internet. 

You may not upload, embed, post, e-mail, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret, or other proprietary rights of any person or entity. Any copyrighted or other proprietary User-Created Content distributed with the consent of a copyright owner should contain a phrase such as “Copyright, owned by [name of owner]; used by permission.” Mythic Fox is entitled to presume that all User-Created Content conforms to the foregoing requirements. The unauthorized submission of copyrighted or other proprietary User-Created Content is illegal and could subject the User to personal liability for damages in a civil suit as well as criminal prosecution. Users assume all liability for any damage resulting from any infringement of copyrights or proprietary rights, or from any other harm arising from an unauthorized submission or submission of User-Created Content. Mythic Fox assumes no liability for any damage resulting from any infringement of copyrights or proprietary rights, or from any other harm arising from any User-Created Content.

By submitting User-Created Content within the Site, Users automatically grant, or represent and warrant that the owner or authorized licensor of such User-Created Content has expressly granted Mythic Fox the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, publish, translate, sub-license, copy, modify, delete, enhance, and distribute the User-Created Content in whole or in part worldwide and/or to incorporate such User-Created Content in other works in any form, media, or technology now known or hereafter developed for the full term of any copyright that may exist in such User-Created Content. Subject to this grant, the licensor of User-Created Content submitted to the Site retains any and all rights which may exist in such User-Created Content.

  1. DISCLAIMER OF WARRANTIES

THE MATERIALS, PRODUCTS, AND SERVICES PROVIDED TO YOU ON OR THROUGH THE WEBSITE ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. MYTHIC FOX ASSUMES NO RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, SUITABILITY FOR ANY PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THE INFORMATION AND MATERIALS PROVIDED ON OR THROUGH THE WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE HEREBY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE, LACK OF HIDDEN OR LATENT DEFECTS, SECURITY, MERCHANTABILITY, SATISFACTORY QUALITY, QUIET ENJOYMENT AND NON-INFRINGEMENT OR ARISING BY REASON OF CUSTOM OR USAGE IN THE TRADE OR BY COURSE OF DEALING.

IN NO EVENT SHALL MYTHIC FOX HAVE ANY LIABILITY FOR DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY) FOR ACCESSING OR USING THE SITE OR MYTHIC FOX SERVICES.

MYTHIC FOX WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE THE WEBSITE, RESULTING FROM ANY TRANSACTIONS ENTERED INTO THROUGH THE WEBSITE OR THE RELATED SERVICES, RESULTING FROM LOSS OF, UNAUTHORIZED ACCESS TO, OR ALTERATION OF A USER’S TRANSMISSIONS OR DATA OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLES, EVEN IF MYTHIC FOX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR AGGREGATE LIABILITY RELATED TO THE SITE OR MYTHIC FOX SERVICES OR YOUR MYTHIC FOX ACCOUNT EXCEED US$100 IN TOTAL (OR THE EQUIVALENT IN LOCAL CURRENCY, TO THE EXTENT THAT LOCAL CURRENCY NEEDS TO APPLY).

  1. Dispute Resolution and Waiver of Class Actions

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND MYTHIC FOX TO AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.

Any dispute or claim arising from, relating to, or connected with these Terms of Use, the Site, Mythic Fox Services, Mythic Fox Content including Digital Content, and/or any Mythic Fox account (each a “Claim”) will be resolved by binding arbitration (rather than in court). All Claims submitted to arbitration under these Terms of Use will be administered by the American Arbitration Association under its Commercial Arbitration Rules (including the Supplementary Procedures for Consumer-Related Disputes, if applicable), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of arbitration shall be the Commonwealth of Virginia or, where limited by applicable law, the jurisdiction in which you reside or may be conducted by telephone, online, or based solely upon written submissions where no in-person appearance is required. Notwithstanding this Section 18, Mythic Fox may bring a Claim for injunctive or other equitable relief in any court of competent jurisdiction as necessary to enforce our intellectual property rights or those of our affiliates, suppliers, or licensors.


Governing Law – These Terms of Use and all matters arising out of them shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to principles of conflicts of laws. You expressly consent to be subject to the personal jurisdiction of the federal and state courts of Virginia related to any injunctive relief Mythic Fox may seek.


Waiver of Class Actions – We each agree that any Claim will be arbitrated or litigated, as the case may be, on an individual basis and shall not be consolidated with any Claim of any other party whether through class action proceedings, class arbitration proceedings, or otherwise. WE EACH AGREE THAT WE ARE KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVING ANY RIGHT WE MAY HAVE TO A JURY TRIAL WITH RESPECT TO ANY LITIGATION ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH THESE TERMS OF USE.


Option to Opt Out – To opt out of the arbitration and class-action waiver terms in this Section 18, you must notify us in writing within 30 days of the date that you first accept these Terms and Conditions of Use (unless a longer period is required by applicable law). Your written notification must include your name, address, and an unequivocal statement that you want to opt-out of this arbitration agreement and class-action waiver terms.

For purposes of any Claim that is not subject to the arbitration procedures in this Section 18, you agree that any disputes arising out of these Terms of Use shall be determined by the federal and state courts of the Commonwealth of Virginia. You expressly consent that in the case of opting out, you agree to be subject to the personal jurisdiction of the federal and state courts of Virginia to determine any aspect of these Terms of Use, including enforcement thereof.


You acknowledge and agree that, regardless of any statute or law to the contrary, any Claim or cause of action you may have must be filed within one (1) calendar year after such Claim or cause of action arises, or forever be barred.

  1. Indemnification

User agrees to indemnify, defend, and hold Mythic Fox (and its affiliates, employees, contractors, agents, suppliers, and partners) and each Mythic Fox Provider harmless from any and all claims, suits, actions, losses, costs, damages, and any other liabilities, including reasonable attorneys’ fees, brought by any third party due to or arising out of (i) such User’s use of the Site or Mythic Fox services, (ii) any alleged breach or violation of the Terms of Use or (iii) such User’s violation of any law or the rights of a third party. Mythic Fox reserves the right, at User’s expense, to assume the exclusive defense and control of any matter for which such User is required to indemnify Mythic Fox, and User agrees to cooperate with Mythic Fox’s defense of such matter. This defense and indemnification obligation is intended to extend to the fullest extent permitted by law and will survive the Terms of Use and your use of the Site and Mythic Fox Services.

  1. Miscellaneous

Survival and Assignment – Any rights or obligations contained in these Terms of Use that by their nature should survive termination of your use of the Site or Mythic Fox services shall survive, including, but not limited to, representations, warranties, intellectual property rights, and indemnity obligations.

We may, without notice, assign our rights and duties under these Terms of Use to any party at any time.


Legal and Equitable Relief – Mythic Fox reserves the right to seek all remedies available at law and in equity for violations of these Terms of Use. In the event of any violation or threatened violation of these Terms of Use, Mythic Fox shall be authorized and entitled to obtain, from any court of competent jurisdiction, preliminary and permanent injunctive relief, as well as an equitable accounting of all profits or benefits arising out of such violation, which right and remedies shall be cumulative and in addition to any other rights or remedies to which we may be entitled. Mythic Fox reserves the right to block access to the Site from a particular Internet address.


Severability –If any provision or part of any provision of these Terms of Use is found to be invalid or unenforceable by any court or other competent body, that provision or part shall be enforced to the maximum extent permissible and such invalidity or unenforceability shall not affect the other provisions (or parts thereof) of these Terms of Use, and such other provisions (and parts thereof) shall remain in full force and effect.


Waiver – If Mythic Fox fails to exercise a right or remedy that it has or that arises in relation to these Terms of Use, such failure shall not prevent Mythic Fox from exercising that right or remedy subsequently in respect of that or any other incident. A waiver of any breach or provision of these Terms of Use shall be effective only if it is made in writing and signed on behalf of Mythic Fox. Any waiver of a breach of any provision of these Terms of Use shall not be deemed a waiver of any subsequent breach and shall not affect the enforceability of any other provision of these Terms of Use.

The provisions of these Terms of Use shall not be modified by the course of conduct between the parties nor by trade practice. 

Integration – These Terms of Use, including the Privacy Policy, the terms of which are fully incorporated herein by reference, set out all of the terms agreed between you and Mythic Fox relating to the subject matter of these Terms of Use and supersede any and all prior and contemporaneous communications or agreements relating to its subject matter.  

Acknowledgement – The Terms of Use, including all documents referenced herein, represents the entire understanding between User and Mythic Fox regarding User’s relationship with Mythic Fox and supersedes any prior or contemporaneous statements or representations. Headings used in the Terms of Use are for reference only and shall not affect the meaning of any terms. As used in these Terms of Use, “including” means “including, without limitation.”

  1. Additional Terms and Conditions

In addition to the policies and guidelines located throughout the Site, the following Privacy Policy is incorporated into the Terms of Use. The terms of this additional policy are fully incorporated into this document by reference. You acknowledge and agree that by using this Site, you are bound by the terms of the Privacy Policy. You expressly consent to the use and disclosure of information as described in those policies. Your continued use of the Site after the effective date of any modification to the Privacy Policy will be deemed to be your agreement to the changed terms.
